Procedures for issuance of Investment Registration Certificate in High-Tech Park

In recent years, our country has been evaluated as one of the countries worth investing in Asia, especially in the field of high technology. However, not only foreign investors but also domestic investors are always hesitant about the procedures of applying for the Investment Registration Certificate when investing in the High-Tech Park  in Vietnam.

Understanding that, AMI would like to share with domestic and foreign investors the knowledge related to the application for Investment Registration Certificate in the High-Tech Park in the context of the legal procedures are complicated.

What’s High-Tech Park?

First of all, AMI wants to give you a better understanding of what a High-Tech Park is and what characteristics it has to have a more general view of the operation of the field you want to invest.

High-Tech Park means a multi-functioned economic-technical park with delimited boundaries, established under a decision of the Prime Minister, aiming to research into, develop and apply high technologies; nurse high-tech enterprises, train high tech manpower, produce and trade in high-tech products.

Procedures for applying for investment registration certificate in High-Tech Park

Because the High-Tech Park is licensed to establish by the Prime Minister. Therefore, in order to invest in High-Tech Park, investor needs to be granted investment licenses to qualify for High-Tech Park. The application for an Investment Registration Certificate in the High-Tech Park is carried out through the following steps:

Step 1: The investor submits technology explanation of project to the High-Tech Park Management Board.

Within 15 working days, the High-Tech Park Management Board will consider and examine the project’s technology explanation. In case of meeting the requirements, the High-Tech Park Management Board shall notify the investor to continue implementing Step 2. In case of meeting the conditions, the Hi-tech Park Management Board shall issue a written refusal or request the investor to supplement the technology explanation.

Step 2: The investor submits dossier for investment license at the Office of the Hi-tech Park Management Board. For foreign investors, before submitting the application, it is necessary to carry out the procedures for online declaration of investment project information.

The expert will receive and check dossier within 03 working days. If the application is valid, go to step 3, if the application is invalid, the expert will instruct the investor to edit and supplement.

Step 3: The High-Tech Park Management Board conducts the appraisal of the dossier within 15 working days

– In case the dossier meets the requirements and conditions: the High-Tech Park Management Board shall grant the Investment Registration Certificate to the investor

– In case the dossier does not meet the requirements: the Hi-tech Park Management Board shall issue a written refusal to grant the Investment Registration Certificate to the investor and clearly state the reason.

Composition of application for Investment Registration Certificate in High-Tech Park

  • Written proposal for implementation of the investment project (form I.1 – Appendix I issued together with Circular No. 16/2015/TT-BKHDT dated November 18, 2015);
  • Proposal for the investment project (form I.2 – Appendix I issued together with Circular No. 16/2015/TT-BKHDT dated November 18, 2015);
  • Documents determining legal status of investors: copy of the identify card or passport, for individual investors; copy of the enterprise registration certificate of the establishment decision or an equivalent document certifying the legal status, for institutional investors;
  • Technology explanation according to the guidance of the High-Tech Park Management Board;
  • Proposal on land use; in case the investor does not propose the State to allocate or lease land or to permit change of land use purposes, the investor shall submit a copy of the site lease agreement or another document certifying that the investor has a right to use the site used for project implementation
  • The BCC, for investment projects in the form of BCC
  • For projects in conditional investment sectors, investor has to submit the explanation proving investor meets the conditions

Note:

  • For foreign investors: when applying for an Investment Registration Certificate in the High-Tech Park, the file must be in Vietnamese-English bilingual; Company establishment documents or other documents of equivalent value must be consular legalized.
  • If the investor does not directly submit the application, it is required to have a power of attorney from the third party representing the investor.
