Currently, overseas study is a trend of many young people, so overseas study counseling service is also very popular. In order to support customers, AMI would like to introduce the procedures to set up an overseas study counseling service company through the following article.
Trading overseas study counseling service is a conditional business line stipulated in the Law No. 03/2016/QH14 amending and supplementing Article 6 and Annex 4 on the list of conditional investment and business lines of the Investment Law. In order to establish an overseas study counseling service company and to carry out this service business, the company must meet the conditions of the license as prescribed by the laws.
In order to be granted the certificate of registration of overseas study counseling service business, its staff of front desk counselors must hold at least the bachelor’s degree, have a good command of at least a foreign language at the 4th level or more as specified in the 6-level Foreign Language Competency Framework of Vietnam or equivalent, and obtain the certificate of completion of overseas study counseling training course required by the Ministry of Education and Training.
Procedures for establishment of overseas study counseling service company:
Step 1: Applying for Enterprise Registration Certificate
- The composition of the application includes:
- Enterprise registration application;
- Draft of company’s charter;
- List of members, List of founding shareholders;
- List of authorized representatives for members, shareholders are organizations;
- Valid copy of one of the documents: Citizen or people’s identity card, passport or other valid personal identification papers, for individual members; Establishment decision or other equivalent documents of the organizations; and one of the personal identification papers of the authorized representative and the corresponding authorization document;
- The investment registration certificate is licensed by the competent authority.
- Settlement agency: Business Registration Office – Provincial Department of Planning and Investment
- Processing time: Within 03 working days from the date of receiving valid dossiers, the Business Registration Agency grants a business registration certificate to the company
Step 2: Applying for the certificate of registration of overseas study counseling service business
Procedures for the company of overseas study counseling service to be granted the certificate of registration of overseas study counseling service business are stipulated in Article 108 of Decree 46/2017/ND-CP as follows:
- The composition of the application includes:
- The application form for the certificate of registration of overseas study counseling service business that describes the following key information such as objectives and details of overseas study counseling services, possibility of provision and development of overseas study counseling services, implementation plan and approaches, measures to deal with possible risks to service customers;
- The duplicate copy derived from the original register, the certified duplicate copy derived from the original copy or the duplicate copy with the original copy for verification purposes of the certificate of business registration, the establishment decision or the certificate of investment registration;
- The list of front desk counselors with the following main information: full name, birth date, gender, qualification level, foreign language proficiency, job position; the duplicate copy derived from the original register, the certified duplicate copy derived from the original copy or the duplicate copy with the original copy for verification purposes of a bachelor’s degree, foreign language certificate and certificate of completion of overseas study counseling service course
- Settlement agency: The overseas study counseling organization sends 01 set of application documents prescribed by Clause 2 of this Article, whether directly or by post, to the Department of Education and Training of the province where its services are provided.
- Processing time: Within the maximum duration of 15 business days of receipt of all legally required application documents, the Director of the Department of Education and Training evaluates the submitted documentation, verifies accuracy of materials enclosed in the submitted documentation and issues the certificate of registration of overseas study counseling service business. If stipulated requirements have not met yet, a written notice must be sent to the requesting organization and clearly describes reasons
