Để hành nghề thú y, mở phòng khám và bán thuốc thú y, các tổ chức phải đảm bảo các điều kiện sau/ In order to practice veterinary medicine, open clinics and sell veterinary drugs, organizations must ensure the following conditions:
1. Các loại hình và Điều kiện hành nghề thú y/ Forms of veterinary practice & Requirements for veterinary practice
Các loại hình hành nghề thú y gồm/ Forms of veterinary practice:
– Tiêm phòng, chữa bệnh, phẫu thuật động vật; tư vấn các hoạt động liên quan đến lĩnh vực thú y/ Inoculation, treatment, surgery of animals; consultation on activities relating to veterinary medicine.
– Khám bệnh, chẩn đoán bệnh, xét nghiệm bệnh động vật/ Examination, diagnosis, testing on animals.
– Buôn bán thuốc thú y/ Trading in veterinary drugs.
– Sản xuất, kiểm nghiệm, khảo nghiệm, xuất khẩu, nhập khẩu thuốc thú y/ Production, analysis, testing, export, import of veterinary drugs.
Điều 107 Luật Thú y 2015
Đối với tổ chức hành nghề thú y thì phải đáp ứng điều kiện/ Regarding organizations practicing veterinary medicine:
– Có cá nhân đáp ứng các yêu cầu: Có Chứng chỉ hành nghề thú y phù hợp với từng loại hình hành nghề thú y; Có đạo đức nghề nghiệp; Có đủ sức khoẻ hành nghề.
– Have staff satisfying the requirements specified: Have the Veterinary practice certificate conformable to specific forms of veterinary practice; Have professional ethics; Healthy enough for veterinary practice.
Người hành nghề chẩn đoán, chữa bệnh, phẫu thuật động vật, tư vấn các hoạt động liên quan đến lĩnh vực thú y tối thiểu phải có bằng trung cấp chuyên ngành thú y, chăn nuôi thú y hoặc trung cấp nuôi trồng thủy sản, bệnh học thủy sản đối với hành nghề thú y thủy sản. Người hành nghề tiêm phòng cho động vật phải có chứng chỉ tốt nghiệp lớp đào tạo về kỹ thuật do cơ quan quản lý nhà nước có thẩm quyền cấp tỉnh cấp.
Each person practicing diagnosis, treatment and/or surgery of animals, consultation on activities related to veterinary medicine is required to obtain at least an associate’s degree in veterinary medicine, or husbandry and veterinary medico or an associate’s degree in aquaculture, or fish pathology for aquatic veterinary practice. Each person practicing inoculation of animals is required to obtain a certificate of graduation from a technical training course granted by a competent authority of the province.
Người phụ trách kỹ thuật của cơ sở phẫu thuật động vật, khám bệnh, chẩn đoán bệnh, xét nghiệm bệnh động vật phải có bằng đại học trở lên chuyên ngành thú y, chăn nuôi thú y hoặc nuôi trồng thủy sản, bệnh học thủy sản đối với hành nghề thú y thủy sản.
Each person in charge of technical matters in a facility provide surgery, treatment and/or diagnosis of animals/animal diseases is required to obtain at least a bachelor’s degree in veterinary medicine, or husbandry and veterinary medicine or aquaculture, or fish pathology for aquatic veterinary practice.
Người buôn bán thuốc thú y phải có bằng trung cấp trở lên chuyên ngành thú y, chăn nuôi thú y hoặc trung cấp nuôi trồng thủy sản, bệnh học thủy sản đối với hành nghề thú y thủy sản.
Each trader of veterinary drugs is required to obtain at least an associate’s degree in veterinary medicine, or husbandry and veterinary medicine or an associate’s degree in aquaculture, or fish pathology for aquatic veterinary practice.
(Điều 21 Nghị định số 35/2016/NĐ-CP quy định chi tiết một số điều của Luật Thú y).
– Có cơ sở vật chất, kỹ thuật phù hợp với từng loại hình hành nghề thú y theo quy định pháp luật.
– Have facilities appropriate to specific forms of veterinary practice according to the law provisions.
(Điều 108 Luật Thú y 2015)
- Thẩm quyền cấp Chứng chỉ hành nghề thú y/ Competence in granting the Veterinary practice certificate:
Cục Thú y cấp Chứng chỉ hành nghề thú y đối với loại hình Sản xuất, kiểm nghiệm, xuất khẩu, nhập khẩu thuốc thú ý/ Department of Animal Health is responsible for granting the Veterinary practice certificates to entities performing the activities specified in Production, analysis, testing, export, import of veterinary drugs
Cơ quan quản lý chuyên ngành thú y cấp tỉnh cấp Chứng chỉ hành nghề thú y đối với các loại hình hành nghề thú y còn lại.
The veterinary authorities of provinces are responsible for granting the Veterinary practice certificates to entities performing the activities specified in the remaining forms of veterinary practice.
- Hồ sơ đăng ký cấp Chứng chỉ hành nghề thú y gồm/ The application for the Veterinary practice certificate shall include:
– Đơn đăng ký/ An application form;
– Văn bằng, chứng chỉ chuyên môn phù hợp với từng loại hình hành nghề thú y/ Qualifications conformable to specific forms of veterinary practice;
– Giấy chứng nhận sức khỏe/ The Health certificate;
– Giấy chứng minh nhân dân hoặc Thẻ căn cước công dân. Đối với người nước ngoài, ngoài những quy định tại các điểm a, b và c khoản này còn phải có lý lịch tư pháp được cơ quan có thẩm quyền xác nhận/ The ID card. Regarding foreigners, apart from the regulations in points a, b and c of this clause, the application shall include the judicial records verified by competent agencies.
Thời hạn/ Duration: 05 ngày làm việc, kể từ ngày nhận được hồ sơ hợp lệ/ Within 05 working days from the day on which the satisfactory application is received
Lệ phí cấp chứng chỉ hành nghề dịch vụ thú y/ Fees for granting veterinary service practicing certificate : 50.000 đồng/lần. VND 50,000/time

*Lưu ý/Note: Chứng chỉ hành nghề thú y có giá trị 05 năm. Sau thời hạn trên, cá nhân tiếp tục hành nghề thú y thì cần phải xin gia hạn chứng chỉ hành nghề thú y tại cơ quan quản lý có thẩm quyền.
The veterinary practice certificate is valid for 5 years. After the above-mentioned time limit, if an individual continues to practice veterinary medicine, must apply for an extension of the veterinary practice certificate at the competent management agency.
Đối với tổ chức, cá nhân buôn bán thuốc thú y phải đảm bảo các điều kiện sau đây/ Requirements for trading in veterinary drugs:
– Có Giấy chứng nhận đăng ký kinh doanh hoặc Giấy chứng nhận đăng ký doanh nghiệp/ Having the Certificate of Business registration or the Certificate of Enterprise registration.
– Có địa điểm, cơ sở vật chất, kỹ thuật phù hợp/ Having appropriate location and facilities;
– Người quản lý, người trực tiếp bán thuốc thú y phải có Chứng chỉ hành nghề thú y/ People who manage or directly perform the sale of veterinary drugs shall have veterinary practice certificates;
– Có Giấy chứng nhận đủ điều kiện buôn bán thuốc thú y/ Having the Certificate of eligibility for trading in veterinary drugs.
– Có đủ quầy, tủ, giá kệ để chứa, đựng và trưng bày sản phẩm phải đảm bảo chắc chắn, dễ vệ sinh và tránh được những tác động bất lợi của ánh sáng, nhiệt độ, độ ẩm, nấm mốc, động vật gặm nhấm và côn trùng gây hại/ Provide the adequate number of counters, cabinets, shelves and racks for handling and display of products and ensure that they are rigid, easy to clean and avoid any adverse impact of light, temperature, moisture, fungi, rodents and pests.
– Có trang thiết bị để bảo đảm điều kiện bảo quản ghi trên nhãn của sản phẩm; có nhiệt kế, ẩm kế theo dõi điều kiện bảo quản sản phẩm. Đối với cơ sở buôn bán vắc xin, chế phẩm sinh học phải có tủ lạnh, tủ mát hoặc kho lạnh; có nhiệt kế để kiểm tra điều kiện bảo quản; có máy phát điện dự phòng, vật dụng, phương tiện vận chuyển phân phối vắc xin bảo đảm điều kiện bảo quản ghi trên nhãn sản phẩm/ Have equipment to ensure conformity with storage conditions inscribed on product labels; keep thermometers and hygrometers in place to keep track of product storage conditions. Traders of vaccines and/or biological preparations must have refrigerators, cooler freezers or cold storage warehouse; must install thermometers for checking the storage conditions; must equip standby generators, utilities and vehicles for transportation and distribution of vaccines to satisfy storage conditions inscribed on product labels

Trình tự, thủ tục cấp Giấy chứng nhận đủ điều kiện buôn bán thuốc thú y/ Procedures for granting of the Certificate of eligibility for trading in veterinary drugs:
– Mẫu đơn đăng ký cấp Giấy chứng nhận đủ điều kiện buôn bán, nhập khẩu thuốc thú y theo mẫu quy định tại Phụ lục XX, XXXI ban hành kèm theo Thông tư 13/2016/TT-BNNPTNT/ An application form for issuance, extension or reissuance of the certificate of eligibility to trade/import veterinary drug using the form provided in Annex XX or XXXI enclosed with the Circular No. 13/2016/TT-BNNPTNT.
– Bản thuyết minh chi tiết về cơ sở vật chất, kỹ thuật buôn bán, nhập khẩu thuốc thú y theo mẫu quy định tại Phụ lục XXII ban hành kèm theo Thông tư này/ A detailed description of facilities and technology for the manufacture of veterinary drug using the form specified in Annex XXII enclosed with this Circular.
– Giấy chứng nhận đăng ký doanh nghiệp hoặc Giấy chứng nhận đăng ký kinh doanh/ The Certificate of Enterprise registration or the Certificate of Business registration;
– Chứng chỉ hành nghề thú y/ The veterinary practice certificate.
Thời hạn cấp phép/ Duration: 05 ngày làm việc, kể từ ngày nhận được hồ sơ hợp lệ/ Within 05 working days from the day on which the satisfactory application is received.
Thẩm quyền/ The Authorities: Cơ quan quản lý chuyên ngành thú y cấp tỉnh/ The veterinary authorities of provinces.
